Terms of Service

The service

"BizPass" is a digital business card and lead-capture platform offered as an iOS app and a web dashboard at bizpass.co. The service is provided by BizPass ("we," "us"). You ("you") are the person using it.

We're in beta. Features will be added, removed, and reshaped. We'll keep the core promise of a working digital business card stable; we may change everything around it.

Your account

• You must be at least 13 years old (or 16 in the European Economic Area).
• Provide accurate information when you sign up, and keep it current.
• Keep your password secret. You're responsible for activity from your account, except where it results from our security failure.
• Notify us promptly at support@bizpass.co if you believe your account has been compromised.

What you can and can't put on a card

You retain full ownership of every card you create. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and transmit that content as needed to run the service (for example, to render a public share page or sync the card to your other devices). That license ends when you delete the content or close your account.

You agree not to use BizPass to:

• Impersonate another person or company
• Share content you do not have the right to share (including someone else's likeness, logo, or trademark without authorization)
• Distribute malware, phishing material, or any link intended to deceive or harm
• Harass, threaten, or send unwanted contact through embedded forms or surveys
• Violate applicable law

We may suspend or remove content and accounts that violate these rules. We try to give notice and a chance to fix it where possible.

Public shares and surveys

When you publish a card via a public share URL or embed a survey, you understand that:

• Anyone with the URL can view the contents.
• Aggregate counts of views, saves, and survey responses become visible in your dashboard analytics.
• You can revoke a share at any time, which makes the URL stop working for new visitors. Visitors with the page already open may keep that view until they refresh.
• Survey responses you collect are subject to applicable privacy law in the respondent's jurisdiction. If you collect personal information through surveys, you're responsible for getting any required consent and for handling the data appropriately.

Paid plans

BizPass offers Free, Advanced (one-time on iOS), and Pro (monthly or yearly subscription). Current pricing is shown in the app and on the website.

• Apple App Store purchases (Advanced one-time unlock, or Pro via in-app purchase) are billed and refunded under Apple's terms. We follow Apple's refund decisions.
• Web subscriptions for Pro are billed by Stripe. You can cancel any time from the Settings → Manage Subscription link, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period; we do not pro-rate partial periods.
• Refunds: if you're unhappy with a web Pro subscription within 14 days of your initial purchase, email support@bizpass.co and we'll refund the most recent payment. Refunds for later periods are at our discretion.
• Price changes apply only to future renewals and we'll email you before the change takes effect.

Service changes and availability

We can modify, suspend, or discontinue any part of the service. For paid plans, if we discontinue a feature you were paying for, we'll refund the unused portion of your current billing period.

We aim for high availability, but BizPass is provided "as available." We make no guarantee that the service will be uninterrupted, error-free, or compatible with any specific device or browser version.

Termination

You can stop using BizPass at any time and close your account from Settings → Delete Account. We can suspend or terminate your account for material breach of these terms; we'll give written notice (typically by email) and an opportunity to fix the issue where reasonable.

On termination by either side, your right to use BizPass ends. We will delete your personal data subject to the retention policy described in our Privacy Policy.

Our intellectual property

The BizPass name, logo, designs, software, and documentation are owned by us. We give you a personal, non-transferable license to use them as part of the service. You don't get any other rights to our IP.

Templates and design assets supplied as part of premium tiers may be used in cards you create and share. You may not extract, redistribute, or resell those assets outside the service.

Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't promise that BizPass will meet your specific requirements, be available without interruption, or be free of errors.

Limitation of liability

To the maximum extent allowed by law, BizPass is not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to BizPass is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

Changes to these terms

We may update these terms. If a change is material (for example, a new payment obligation), we'll email account holders and give at least 30 days' notice before the change takes effect. Continued use of the service after the effective date counts as acceptance.

Governing law

These terms are governed by the laws of the United States and the State of California, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, and you and we both consent to that venue.

If you're a consumer in the European Union, United Kingdom, or another jurisdiction that grants you mandatory rights to bring claims in your home courts, nothing in this section limits those rights.
